Facebook, Instagram and Tiktok Contests regulation
ARTICLE 1: ORGANIZING COMPANY
DConnect, a limited liability company incorporated under Belgian law, registered with the Crossroads Bank for Enterprises under number 1016.266.624, whose registered office is located at 24, rue Abel Roger, 7070 Le Rœulx (Belgium), duly represented by Sébastien Hiernaux in his capacity as Chief Executive Officer (hereinafter referred to as the "Organising Company"), organise competitions within the framework of its Instagram accounts, Facebook and TikTok around the disconnection and the objectives of DConnect, the conditions of which are indicated in these rules (hereinafter collectively referred to as the "Contests" or separately the "Contest").
ARTICLE 2: PARTICIPATION
1. These Competitions are open to any natural person residing in Belgium, the Netherlands, Luxembourg and France. Persons who have participated in the direct or indirect development of the Competitions (and in particular members of the Organising Company) are excluded.
2. The Organising Company reserves the right to ask any participant to justify these conditions. Any person who does not meet these conditions or refuses to justify them will be excluded from the Competitions.
3. For minors wishing to participate, the parents or legal guardian declare, by participating in one of the Contests, that they approve of the rules. The Organizing Company reserves the right, when designating the winner(s), to have these rules approved by a parent or legal guardian if a minor has been chosen from among the winner(s).
4. Participation in one of the Contests implies full and unreserved acceptance of these rules. The participation of any resident of a country other than Belgium, the Netherlands, Luxembourg and France will not be taken into account.
5. Any practical difficulties of application will be decided by the Organizing Company.
6. Contact details that are incomplete, do not comply with the rules or received after the entry deadline will not be considered.
7. Apart from requests for payment, no written or telephone request concerning the operation of these Competitions will be answered.
ARTICLE 3: ACCESS AND DURATION
1. Each of the Contests is open from the moment of publication posted on the Instagram, Facebook and TikTok accounts of the Organizing Company DConnect and for a maximum period of 21 days. No participation in the Competitions will be possible after this deadline.
2. These Contests are free of charge and no purchase is necessary.
3. The Competitions will be announced via:
- The Facebook pages of the Organizing Company as well as on the Instagram and TikTok accounts of the Organizing Company;
- Any partners of the Organizing Company.
4. The Organising Company reserves the right to postpone, modify, cancel or renew the Competitions and the prizes at stake if circumstances so require. In any event, it cannot be held liable in this respect.
ARTICLE 4: PRINCIPLE OF THE CONTESTS AND DESIGNATION OF THE WINNER(S)
1.1. : Principle of the Contests :
1. In the context of each of the Competitions, their principles consist of two stages:
a) Answer the following question in the comments: estimate the number of visitors to the DConnect website on the date indicated in the publication and indicate it in the comments.
b) Like the publication of the Contest in question.
2. Any answers that are contrary to public order and morality are prohibited. Thus, the Organizing Company reserves the right to withdraw from one of the Contests, without notice, any response of a pornographic, racist nature, inciting violence or not corresponding to the theme of the Contest in question.
3. The winners will be determined in the following order:
a) Proximity to the estimate: Participants who gave an estimate closest to the actual number of visitors to the DConnect site will rank higher.
b) Anteriority of the answer: In the event of a tie between several participants, the one who published his comment first will be ranked higher.
c) Descending ranking: This principle then applies to participants whose estimate is less and less close to the actual figure.
d) Final tiebreaker: In the event of a new tie between several participants at the same level of precision, priority will be given to the one who answered the earliest.
Each participant is responsible for the accuracy of the information provided. Participants are informed that the Organizing Company may carry out any verifications in this regard without having to inform them of the verification on the one hand, or of their subsequent exclusion on the other.
1.2. : Designation of the winner(s ):
1. The selection of the winner(s) will take place within 10 days of the end of each of the Competitions from among all participants whose entry has been validly submitted in the context of the Competition in question.
2. The winner(s) will be contacted by private messages (Facebook, Instagram or TikTok) to announce the prize received.
ARTICLE 5: PRIZES
1. List of prizes:
- The prize(s) for each of the Contests will be specified when each of the Contests is published on the Facebook, Instagram and TikTok accounts of the Organizing Company DConnect.
2. Prizes are non-exchangeable, non-replaceable, non-refundable, and may not be redeemed for any monetary consideration for any reason, including loss, theft or damage.
3. Prizes that cannot be awarded due to an error, omission or modification in the contact details provided by the winner(s) of each Contest will be kept by the Organizing Company.
ARTICLE 6: TERMS AND CONDITIONS OF POSSESSION OF THE PRIZE
1. Each of the winners will be notified personally by private message, no later than 10 days after the end date of each of the Competitions. The results will be published in the comments of each of the publications of the Contests on the Facebook, Instagram and TikTok accounts of the Organizing Company DConnect.
2. The winner(s) will have a period of 15 days from receipt of the private message to confirm his/her acceptance of the prize and confirm his/her contact details. Any winner who does not respond within this period will be deemed to have forfeited their prize altogether. At the end of this period, the unclaimed prize will be permanently lost.
3. The prizes will be sent within two months of the announcement of the results of each of the Competitions. They will be sent by the Organising Company by post.
4. The prizes may not give rise to any dispute of any kind, nor to the delivery of their equivalent value in cash, nor of any consideration of any kind whatsoever.
5. The Organizing Company cannot be held liable in the event of non-delivery of the private message announcing the win, in the event of failure of the access provider, in the event of failure of the internet network or in any other case.
6. The Organising Company reserves the right to ask any participant to justify the information provided when participating in one of the Competitions and in particular to allow itself to carry out all checks on the identity or contact details of the participant.
7. However, the Organising Company reserves the right, in the event of force majeure, to replace the prize offered by another prize.
ARTICLE 7: ADVERTISING AND PROMOTION OF THE WINNER(S)
1. By the mere fact of their participation in one of the Contests, the winner(s) authorizes the Organizing Company to reproduce and use his/her contact details (Instagram handle) and his/her answer to their two questions, on the one hand via the social networks (Instagram, Facebook, Twitter) of the Organizing Company and via the various means of communication of the Organizing Company and, on the other hand, in any promotional offer and public-promotional event related to the Contest in question, without this use conferring on the winner(s) any right to remuneration or any advantage whatsoever.
2. The participant guarantees that he or she is not bound by an exclusive contract relating to the use of his or her image or name.
3. Each winner agrees in advance to the use of his or her answers to the questions, his or her first and last name on any medium whatsoever, for advertising or other communication purposes, on the internet or not, for a maximum period of 1 year without this use giving rise to any benefit other than the prize won. In the event that a winner does not wish to do so, he or she must stipulate this in writing in the email sent to the Organizing Company when confirming the acceptance of his or her winnings.
ARTICLE 8: LIABILITY
1. The Organising Company is released from any liability in the event of a malfunction of the "Internet" network preventing the smooth running of one of the Competitions, in particular due to external malicious acts.
2. The Organizing Company cannot be held responsible for input errors and/or technical malfunctions that may prevent the sending of private messages and/or the smooth running of one of the Contests.
3. The Organizing Company declines all responsibility for the routing, quality and condition of the prices on delivery. In the event of the return of the prizes to the Organizing Company, the winner(s) will lose the benefit of his/her gift.
4. In addition, it cannot be held liable under any circumstances in the event of problems with the delivery or loss of postal or electronic mail.
5. The Organising Company reserves the right to exclude from one of the Competitions and to take legal action against any person who has cheated or disturbed the smooth running of one of the Competitions.
ARTICLE 9: PROCESSING OF PERSONAL DATA
1. The Organising Company is required to process personal data relating to participants or communicated by them, on the occasion of their participation in one of the Competitions and the communication around it, as well as in the context of the provision of prizes to the winner(s).
2. The personal data collected or produced in this way will be used mainly for the following purposes:
(i) administrative management, for example: information of the winner(s), sending of prizes, etc.
(ii) communication around the Competitions on the Organising Company's websites and social networks.
3. The personal data of participants collected by the Organizing Company will be used:
(i) by the Organising Company in the context of the Competitions;
(ii) by any partner of the Organizing Company;
(iii) by any third party authorised by the regulations, legislatives, etc.
4. The participants concerned by the processing of their personal data have a right of access to it and may also request that inaccurate, incomplete or outdated data be rectified, updated or deleted and object, subject to justifying a legitimate reason, to the processing of personal data concerning them.
Participants acknowledge that they will not be able to object to the processing of their personal data when such processing is necessary for the performance of the obligations set out in this Regulation.
5. The personal data of participants is stored and kept by the Organizing Company itself and/or any subcontractor of its choice for the duration necessary for the strict performance of its obligations referred to in these rules and at least for the entire duration of the Contest in question and its communication.

ARTICLE 10: CONSULTATION OF THE RULES
1. The full payment will be sent, free of charge, to any person on request by email to the info@dconnect.app address.
Only one request for a copy will be taken into account per household.
2. It is also possible to consult the rules on the website of the Organizing Company accessible at the url address: https://dconnect.app/en/contest-rules.
3. No other oral request concerning any of the Competitions will be answered.
4. The Organizing Company reserves the right to modify these rules, any modification will be available on the https://dconnect.app/en/contest-rules.
ARTICLE 11: DISPUTES
1. The mere fact of participating in one of the Contests entails full and complete acceptance of these rules.
2. If one or more provisions of this Regulation are declared null and void or unenforceable, the other clauses shall retain their full force and scope.
3. These regulations are subject to Belgian law. Any practical difficulty in the application or interpretation of these rules will be decided by the Organising Company. Any dispute arising during one of the Competitions will be submitted to the court of Mons. No dispute will be admissible one month after the end of one of the Competitions.
